1. Scope of Application

The terms and conditions present below (the “Terms and Conditions”) apply to all use of this website, provided by Honig’s Whistle Stop Canada Inc., (“we” or “us”) accessible at http://www.honigs-canada.com/ (the "Website") and all purchases of products through the Website. With your use of the Website or purchase of products through the Website, you agree to these Terms and Conditions and further agree that all agreements, notices, disclosures and other communications that Honig’s Whistle Stop Canada Inc. provides to you electronically satisfy any legal requirements that such agreements, notices, disclosures and other communications be in writing.

2. Orders and Purchases

Any orders placed by you on this Website constitute a binding offer by you to complete a purchase with Honig’s Whistle Stop Canada Inc. The binding purchase agreement comes into existence only when Honig’s Whistle Stop Canada Inc. accepts your order on the Website by sending you an e-mail, telephone call, written communication, or by shipping the products ordered.

2.1 Methods of Payment

Visa and MasterCard are the methods of payment we accept. To process your payment, the billing address information you enter during checkout must match the information your credit card provider has on file. The checkout process and the information you enter during checkout is protected with SSL encryption from GoeTrust Inc. Please be aware that we do not accept Interac, money orders or cheques through online purchase. When you submit an order through our online store, your credit card will be authorized for the total cost of the ordered product(s), applicable taxes and shipping costs (where applicable). You agree that the products ordered and sent to you remain Honig’s Whistle Stop Canada Inc.’s property until full payment has been received by Honig’s Whistle Stop Canada Inc. Risk of loss or damage passes to you at the time the products you order are delivered to the delivery service.

2.2 Pricing and Currency

All prices are listed in Canadian Dollars. Payments made with a foreign credit card will be billed using a currency conversation rate determined by the bank which issues the credit card.

2.3 Taxes

The prices on this Website exclude all applicable taxes, customs, duties and levies. When Honig’s Whistle Stop Canada Inc. Is required by law to collect applicable taxes relating to your order, you authorize Honig’s Whistle Stop Canada Inc. to charge the applicable taxes to your credit card. All orders shipping within Ontario are subject to 13% HST. Orders shipping to other Canadian provinces will be charged the appropriate HST or GST and PST amounts valid at the time of purchase.


3. Shipping and Policies 
The product(s) ordered by you, the customer, will be delivered to the address you provide at the time of your order. Honig’s Whistle Stop Canada Inc. will ship to Post Office Boxes (P.O. Boxes) however, we will not ship to freight forwarding services.

3.1 Processing and Shipping
Honig’s Whistle Stop Canada Inc. will make every attempt to ship all orders by the next business day before 2:00pm EDT., however, does not ship on weekends or statutory holidays. All orders placed on a Friday will be processed latest on the following Monday (unless it is a holiday).

3.2 Processing Delays
For some orders there may be additional processing time due to order size, inventory status, or the volume of orders we are processing. In these situations we will notify you of the delay via email or telephone as soon as possible.

3.3 Shipping & Handling
Standard shipping/handling charge for ground delivery of retail/non-discounted orders is $14.99 (for Ontario residents only) per order. This is not determined by the amount, volume or destination. Discounted accounts will assume, at a minimum, exact shipping charges including insurance Orders are shipped using Common Carriers based on cost effective delivery that may include, but not limited to, one courier service.
Expedited Two Day delivery is available for an additional amount. LIMITATONS: Weight cannot exceed 15 lbs dimensional (DIM) weight, No dealer orders. This delivery option may, at our exclusive discretion.
All orders to Alaska, Hawaii and Puerto Rico are shipped via expedited 2 day delivery, and this upgrade is $8.00. For APO/FPO. Canadian and other locations outside the U.S.A., $3.00 handling plus the actual freight will be charged. We will make every effort possible to give you an estimate of this charge when you place your order.
Overnight service is available at published cost plus our standard shipping/handling charge of $6.95. Overnight orders must be received by 1:00 PM. Quotes of Overnight shipping costs cannot be given until order is processed for shipment and actual weight and dimensions are determined.

3.4 Delivery Information
Deliveries are made Monday-Friday during regular business hours only. Deliveries are not made on weekends or statutory holidays. Deliveries are made on a ‘Release without Signature’ basis which means that the driver will leave shipments for you at a private residence even if you are not available to sign for it. Should you wish to have the shipment delivered only upon signature, please contact us directly after placing your order at sales@honigs-canada.com to select this option at no extra charge.
Should you choose to have a delivery release with signature and you are not present at the time the carrier attempts to make the delivery, a notice will be left listing important information, such as if and when the driver will attempt to redeliver or whether a signature is required to release the package. It is the responsibility of the receiving party to contact the carrier to coordinate a time of delivery if it cannot be done during normal business hours.


4. Exchange, Credit and Refunds
Returns and exchanges are handled without charge if done within 30 days. If you aren't 100% satisfied, merchandise can be returned for exchange, credit or refund. Shipping and handling charges are not refundable.
Products returned after 30 days will be subject to a re-stocking charge of 10%. Products that are altered or worn are non-returnable/refundable, unless defective.
Once your return has been received, a credit will be issued to the credit card used to purchase the product(s) you are returning. The product will be returned at your expense to Honig’s Whistle Stop Canada Inc. unless the return is a result of our error or manufacturer’s defect. In this case, we will refund you the necessary cost of shipping the product through Canada Post.


4.1 Return Procedures
Any new, unused products can be returned for refund or replacement within 30 days of shipping date for item(s) purchased directly from www.honigs-canada.com. Any products that are returned as permitted under these Terms and Conditions must be shipped to the following address:

All returns must be accompanied by the original receipt along with a written reason for the return. Please be sure to include your name, address and telephone number as we will not accept any packages without a return name and address. Please send parcels prepaid as you are responsible for the costs and arrangements for the shipment of the products to be sent back to us. You must take care that the products are not damaged during their return. The risk of loss or damage to the products remains with you until the products are received at our office. Consider appropriate insurance as well as delivery confirmation options as we cannot take responsibility for lost or misdirected returns. Please allow 2 weeks from receipt of return for your refund to be processed.


5. Disclaimers
The website www.honigs-canada.com is provided on an “as is”, “where is” and “as available” basis. Neither Honig’s Whistle Stop Canada Inc. nor its affiliates warrant that the use of the Website will be uninterrupted or error-free. Honig’s Whistle Stop Canada Inc. and affiliates will also not warrant the accuracy, integrity or completeness of the content provided on the website. You are in agreement with using this Website at your sole risk.


6. Reservations and Exceptions
Honig’s Whistle stop Canada Inc. makes every effort to insure the accuracy of our website. However, typographic, photographic, and/or descriptive errors are subject to correction. In the event that a product becomes unavailable, we reserve the right to substitute a similar brand or product or equal or greater value. In either case, we will attempt to inform you at the time of ordering. We reserve the right to limit product quantities to dealers, and actual shipping charges will apply. Honig’s Whistle Stop Canada Inc. reserves the right to change prices, terms, specifications for products on this website and any promotional offers and any other part of this website at any time without prior notice and without liability.


7. Modifications and Waivers
Honig’s Whistle Stop Canada Inc. reserves the right to make changes to the website and these Terms and Conditions at any time by updating this posting. By using the website, you agree to be bound by the Terms and Conditions in effect at the time of your use or purchase.

Here at Honig’s Canada, we collect and use Personal Information to provide you with the services you have requested and to offer you additional products and services we believe you might be interested in. After you have made an online order a customer service representative may call to confirm your credit-card information.
The types of Personal Information we may ask for depends on the nature of the services we provide you and typically includes your name, address, telephone number and e-mail address. If you are ordering over the phone this may include your credit card information.
Any data you implicitly and consciously provide will become the property of Honig’s. This also applies if you send us an e-mail.

All employees are expected to maintain the confidentiality of customer information at all times and failing to do so will result in appropriate disciplinary measures, which may include dismissal.

You hold the right to refuse to consent to our collection of information, however such refusal to or withdraw information may affect the information, products and services we can provide to you.
